Terms of Service

These Terms of Service (the “Terms”) set forth the conditions for using the CookDrawer application (the “Service”). By using the Service, all users (“Users”) agree to these Terms.

Article 1 (Application)

These Terms apply to all matters relating to the use of the Service between Users and the operator of the Service (the “Operator”).

The handling of Users’ personal information is governed separately by the Privacy Policy.

Article 2 (Use by Minors)

The Service is not primarily directed to children.

Users under 18 years of age (minors) must use the Service with the consent of a legal representative, such as a parent or guardian.

If a different age threshold or consent procedure applies under applicable law, the User must comply with that law.

Article 3 (Service Features)

The Service provides the following features:

  • Recording and managing recipe information, including ingredients, instructions, and notes, and shopping lists
  • Adding optional images, camera OCR, and CSV export
  • Backing up and restoring data using iCloud or similar services
  • Extracting and saving recipe information through external services when a URL or text is entered or shared
  • Other related features provided by the Operator

Article 4 (User Accounts)

The Service may automatically create an anonymous account through Firebase Authentication in order to provide authentication, recipe extraction from URLs, usage-count management, and certain other features. Users may optionally link their account using Sign in with Apple.

Users are responsible for appropriately managing their device, Apple ID, and any account information linked to the Service.

All actions performed through an account will be deemed to have been performed by the User associated with that account.

Article 5 (Paid Features and In-App Purchases)

Certain features of the Service are provided through an auto-renewable paid subscription (a “Subscription”) or a one-time in-app purchase.

The price, duration, included features, and other conditions of each product are as displayed in the Service or on the App Store at the time of purchase.

While a Subscription is active, a higher usage allowance for importing recipes from URLs or similar sources is provided than under free use or the one-time purchase. When the Subscription ends, this allowance returns to the standard allowance.

Users who have purchased a Subscription at least once may continue to use the Plus features described at the time of purchase, excluding the higher usage allowance, after the Subscription ends. A one-time purchase provides continued access, for a single payment, to the Plus features described at the time of purchase.

However, if a purchase is canceled, refunded, determined to be fraudulent, or otherwise becomes invalid through Apple or a payment service, the Operator may discontinue the features or rights based on that purchase.

A Subscription automatically renews unless canceled by the User.

Users can manage their Subscription and disable automatic renewal in their device settings.

Purchase cancellations, Subscription cancellations, and refunds are governed by Apple’s terms and procedures.

The Operator may offer a free trial or other trial period for the Service. The content, duration, eligibility requirements, conditions for charging after the trial, and other terms will be as displayed in the Service or on the App Store.

If a free trial is offered, it may automatically convert to a paid Subscription at the end of the trial unless the User cancels it in the prescribed manner. Cancellation, billing, and refunds are governed by Apple’s terms and procedures.

Auto-Renewable Subscription Terms

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel your subscription in your device's Account Settings after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.

Article 6 (Recipe Information from External Websites)

Recipe information extracted from a URL is based on content from an external website. The Operator does not guarantee its accuracy, completeness, or legality.

Users must comply with the external website’s terms of use and applicable copyright laws when using extracted recipe information.

The extraction feature may not function properly if the content or specifications of an external website change.

Users are responsible for their handling of information extracted and saved from external websites, including its use, reproduction, sharing, and publication. Any dispute with a third party must be resolved by the User at the User’s own responsibility and expense.

If a third party reports an infringement, the Operator may delete temporary server data, disable extraction for the relevant URL, or take other necessary action. The Operator does not remotely delete data already saved on a User’s device.

Article 7 (User Content)

Users retain the rights to recipes, notes, and other data they save in the Service (“User Content”).

The Operator may handle User Content to the extent necessary to provide and improve the Service.

The Operator may reproduce, store, convert, analyze, or otherwise process User Content to the extent necessary to provide the Service, including storage, synchronization, display, backup, and migration, and for maintenance, prevention of misuse, and quality improvement.

The Operator may create statistical information from User Content after processing it so that individuals cannot be identified, and may use that information to improve and analyze the Service.

Article 8 (Data Management)

The Operator will make reasonable efforts to preserve User Content but does not guarantee its integrity or permanent availability.

The Operator is not liable for data loss caused by system failures, communication failures, or other circumstances not attributable to the Operator.

Users are responsible for backing up important data.

To request deletion of server data, a User must apply through support. After identity verification, the Operator will handle the request except for information that must be retained for legal or operational reasons. Data on the device and backups in the User’s iCloud storage are not deleted automatically and require separate action by the User.

The Operator may use cloud services provided by third parties, such as databases and storage, to provide the Service. Users consent to User Content being stored and processed through those cloud services.

The Operator may change storage locations, backup methods, processing methods, or similar technical arrangements to improve the Service.

Article 9 (Prohibited Conduct)

Users must not engage in any of the following conduct:

  • Conduct that violates laws or public order and morals
  • Conduct that infringes the rights of the Service or any third party
  • Unauthorized access, analysis, or reverse engineering
  • Conduct that interferes with operation of the Service
  • Any other conduct that the Operator reasonably determines to be inappropriate

Article 10 (Action in the Event of a Violation)

If a User violates these Terms, the Operator may suspend or delete the User’s account or take other necessary action without prior notice.

Article 11 (Disclaimers and Limitation of Liability)

The Service does not guarantee cooking results, health outcomes, or safety.

If a User suffers damage due to circumstances attributable to the Operator, the Operator will be liable in accordance with applicable law. However, where the damage is caused by the Operator’s ordinary negligence, liability is limited to ordinary and direct damages actually incurred.

The limitation in the preceding paragraph does not apply to damage caused by the Operator’s willful misconduct or gross negligence.

The Operator is not liable for delays or interruptions of the Service caused by maintenance, failures, communication problems, suspension of external services, or other circumstances not attributable to the Operator.

Article 12 (Changes to or Discontinuation of the Service)

The Operator may change, add to, or discontinue all or part of the Service when reasonably necessary for operational reasons. If such action will have a material impact on Users, the Operator will provide reasonable advance notice, except in emergencies or unavoidable circumstances.

Article 13 (Changes to These Terms)

The Operator may amend these Terms in accordance with applicable law if the amendment is in the general interest of Users, or if it is reasonable in light of the necessity of the amendment, the appropriateness of the amended provisions, and other relevant circumstances.

When amending these Terms, the Operator will announce the details of the amendment and its effective date through the Service, on the website, or by another appropriate method.

Article 14 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Unless otherwise required by law, the court having jurisdiction over the Operator’s location will have exclusive jurisdiction as the court of first instance over disputes relating to the Service.

Article 15 (Notices and Communications)

The Operator may send notices or communications to Users by any method the Operator considers appropriate, including in-app notices, publication on the website, or email to a registered address.

Such notices or communications will be deemed to have reached the User when they would ordinarily have been received.

Article 16 (Intellectual Property Rights)

All copyrights, trademark rights, and other intellectual property rights relating to the Service belong to the Operator or their respective lawful owners.

Permission to use the Service under these Terms does not grant Users any license to use intellectual property rights relating to the Service.

Article 17 (No Assignment)

Users may not assign or pledge their status under these Terms or their rights or obligations under these Terms to any third party without the Operator’s prior written consent.

Article 18 (Exclusion of Anti-Social Forces)

Users represent and warrant that they are not an organized crime group or other anti-social force and have no relationship with any such force.

If a User breaches the preceding paragraph, the Operator may suspend the User’s use of the Service, delete the User’s account, or take other necessary action without prior notice.

Article 19 (Severability)

If any provision of these Terms, or any part of a provision, is held invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect.

Article 20 (External Services)

The Service may integrate with or use external services provided by third parties, including cloud infrastructure, AI processing, purchase management, and retrieval of external content information.

Use of an external service may be subject to the terms established by its provider.

Changes to or suspension of an external service may make part of the Service unavailable.
